Consumer Proposal or Filing Bankruptcy?

Your debt solution may involve bankruptcy, but it could include filing a consumer proposal as an alternative to bankruptcy. A consumer proposal is a viable debt relief option for those who have significant assets, such as home equity, or earn a higher income. In a consumer proposal you keep all your assets.

In a consumer proposal, you make a deal with your creditors to settle your debts for a portion of what you owe. Once accepted, this negotiated settlement is legally binding on all unsecured creditors. A consumer proposal can eliminate credit card debt, tax debt and other unsecured debt. Because you repay only a portion of your debts, without interest, a consumer proposal can be a cheaper alternative to a high cost debt consolidation loan or second mortgage or a viable option if you do not qualify for refinancing with your house equity.

A consumer proposal must be filed through a Licensed Insolvency Trustee like Hoyes Michalos. Our consultations are always free so there are no up-front fees and no costs until a proposal is filed with the government.

Bankruptcy is an option of last resort, but it should still be considered when looking at your debt relief options. A legal process under the Bankruptcy and Insolvency Act, bankruptcy will stop collection calls and wage garnishments. If this is your first bankruptcy, you could be eligible for discharge in as soon as 9 months. We will help you compare the cost of filing bankruptcy with options like a consumer proposal or debt management plan. If you choose to file bankruptcy, Nicholas will explain the process and answer any questions you have.
